Private Limited. Fitneter Technology Private Limited (“Company”, “We”, “Us”, or “Our”) is a private
limited company registered under applicable Indian law, with its registered office in Kolkata, West
Bengal and operations in Agartala, Tripura, operating the mobile application and website branded as
“FITNETER” (the “Platform”). By visiting and/or using our website/app, you agree to this Privacy
Policy. This Policy incorporates and includes our Terms and Conditions available on the Platform.
1. Information Collection and Its Usage
We collect personal, location, and financial information from you when you create or update your
Account, browse products, or purchase items from Vendors on the Platform.
A. Information You Give Us
- Contact Information: Name, email address, mobile number, and residential/shipping address.
- Order Details: Products purchased, specific Vendors selected, and preferred delivery or pickup method.
- Customer Support Data: Information you provide when you contact our support team (e.g., chat logs, emails).
- Vendor Specific Data (For Sellers): Proprietor Name, GSTIN, Shop Location, and Bank Account details (Account Number, IFSC) for payouts.
B. Information We Collect Automatically
- Device Information: hardware model, operating system and version, unique device identifiers (IMEI/UUID), and mobile network information.
- Usage Data: Platform access dates and times, products viewed, search queries, features used, crashes, system activity, and third-party sites or services used before interacting with our Platform.
- Location Information: We collect your precise GPS location to show nearby Bicycle, Fitness & sports stores, calculate the exact delivery distance between you and the Vendor, and determine the applicable Delivery Fee based on that distance.
C. Permissions We Request
- Location: To accurately calculate delivery charges and locate nearby Vendors.
- Camera/Storage: To upload profile pictures, product images (for Vendors), or images for return/refund claims.
- Internet/Network: To connect to our servers to browse inventory and process orders.
2. Personal Information of User
Personal Information means and includes all information that can be linked to a specific
individual or to identify any individual, such as:
- Identity & Contact: Name, age, gender, address, mailing address, telephone number, email ID.
- Transaction Data: Order history, billing details, and invoices generated via the App's billing software.
- Financial Details: Bank account details, UPI IDs, wallet credentials, and payment instrument details used for transactions. We do not store your full credit/debit card numbers or CVV — these are processed directly by our PCI-DSS compliant payment gateway partners.
3. Usage of Personal Information
We use your personal information with your consent to provide you with services & products you
explicitly requested: to create and verify your account; display relevant inventory from Vendors in
your vicinity; calculate accurate, distance-based delivery fees; process payments and generate
invoices; facilitate the Delivery and Self-Pickup processes; resolve disputes between you and the
Vendor; detect fraud; send transactional and marketing communications (you may opt-out of marketing);
and perform data analysis to improve the Platform's stability and user experience.
4. Sharing and Disclosure of Personal Information
- Vendors: We share your Name, Mobile Number, and Delivery Address with the specific Vendor you purchased from, so they can deliver the product or verify your identity for pickup.
- Payment Gateways: We share data with government-authorized payment gateways to process your transactions securely.
- Service Providers: We may share data with third-party vendors providing services on our behalf (cloud hosting, data analytics, customer support tools), bound by contractual confidentiality obligations.
- Legal & Regulatory: We may disclose information if required by law or in response to subpoenas, court orders, or other legal processes.
- Business Transfers: If Fitneter is involved in a merger, acquisition, or sale of assets, your user data may be transferred as part of that business asset; you will be notified of any change in ownership.
While your information is shared with third parties (like Vendors or Payment Gateways), the use
and processing of your personal information by them is governed by their respective policies. We do
not accept responsibility or liability for the usage of your personal information by these third
parties beyond the scope of the Fitneter transaction.
5. Storage and Retention of Personal Information
We store your data on secure cloud servers located in India. Account Data is retained as long as
your account is active. Transaction Data is retained for a longer period (e.g., 5-8 years) as
required by Indian tax and accounting laws for auditing purposes.
6. Security Practices
We implement reasonable physical, administrative, and technical safeguards, including SSL/TLS
encryption for data transmission and restricted access controls. You are responsible for maintaining
the secrecy of your login credentials and OTPs — we are not responsible for any security breach
caused by your failure to keep your credentials secure.
7. Cookies
We use session cookies (to operate our Service and keep you logged in), preference cookies (to
remember settings like your location), and security cookies. You can instruct your browser to refuse
all cookies, though some portions of the Service (e.g., keeping items in your cart) may not work
without them.
8. Consent
By using our Platform and/or by providing your information, you consent to the collection and use
of the information you disclose in accordance with this Privacy Policy, including sharing your
information with Vendors for order fulfillment.
9. Your Rights
You have the Right to Access a copy of the personal data we hold about you, the Right to
Correction of inaccurate data in your account settings, and the Right to Deletion of your account and
associated data (subject to legally required retention of certain transaction data). To exercise

10. Children’s Privacy
Our application is directed to be used by adults only (18+). We do not knowingly collect
information from minors. If we discover that a minor has provided us with personal information, we
will delete such information from our servers immediately.

13. Applicable Law & Jurisdiction
This Privacy Policy is governed by and construed in accordance with the laws of India. Any
disputes relating to this Policy are subject to the exclusive jurisdiction of the courts at Kolkata,
West Bengal, India.
