Fitneter Technology Private Limited (hereinafter referred to as the “Company”, “We”, “Us”, or “Our”) is a private limited company registered under applicable Indian law, having its registered office in Kolkata, West Bengal and operations in Agartala, Tripura. We operate the mobile application and website branded as “FITNETER” (hereafter referred to as the “Platform”).

We recognize the importance of maintaining your privacy. We value your trust and appreciate your confidence in us. This Policy describes how we treat user information we collect on the Platform. This Privacy Policy applies to current and former visitors to our Platform and to our online customers. By visiting and/or using our website/app, you agree to this Privacy Policy.

In order to provide you with access to our Platform and Services (specifically the listing of sports products, processing of payments, and facilitating vendor-managed delivery), we need to collect various data and information from you. This Privacy Policy (“Policy”) deals with how this data and information is collected, retained, shared, stored, and processed by us.

This Policy incorporates and includes our Terms and Conditions available on the Platform. Words and phrases not defined in this Policy shall have the same meaning as provided in the Terms and Conditions.

1. INFORMATION COLLECTION AND ITS USAGE

We collect personal, location, and financial information from you when you create or update your Account, browse products, or purchase items from Vendors on the Platform. We collect data in the following ways:

A. Information You Give Us:

● Contact Information: Name, email address, mobile number, and residential/shipping address.

● Order Details: Products purchased, specific Vendors selected, and preferred delivery or pickup method.

● Customer Support Data: Information you provide when you contact our support team (e.g., chat logs, emails).

● Vendor Specific Data (For Sellers): Proprietor Name, GSTIN, Shop Location, and Bank Account details (Account Number, IFSC) for payouts.

B. Information We Collect Automatically:

● Device Information: We collect information about the device you are using to access the Platform, including the hardware model, operating system and

version, unique device identifiers (IMEI/UUID), and mobile network information.

● Usage Data: We collect data on your interaction with our Platform, i.e., Platform access dates and times, products viewed, search queries, features used, crashes, system activity, and the third-party sites or services used before interacting with our Platform.

● Location Information (Crucial for Service): We collect your precise GPS location to:

􀀀 Calculate the exact delivery distance between you and the Vendor.

􀀀 Determine the applicable Delivery Fee based on that distance.

C. Permissions We Request:

To provide the full functionality of the App, we may request access to the following permissions on your mobile device:

● Location: To accurately calculate delivery charges and locate nearby Vendors.

● Camera/Storage: To allow you to upload profile pictures, product images (for Vendors), or images for return/refund claims.

● Internet/Network: To connect to our servers to browse inventory and process

orders.

2. PERSONAL INFORMATION OF USER

Personal Information means and includes all information that can be linked to a specific individual or to identify any individual, such as:

● Identity & Contact: Name, age, gender, address, mailing address, telephone number, email ID.

● Transaction Data: Order history, billing details, and invoices generated via the App's billing software.

● Financial Details: Bank account details, UPI IDs, wallet credentials, and payment instrument details used for transactions.

􀀀 Note: We do not store your full credit/debit card numbers or CVV. These are processed directly by our PCI-DSS compliant payment gateway partners.

3. USAGE OF PERSONAL INFORMATION

We use your personal information with your consent to provide you with services & products you explicitly requested. Specifically:

Service Delivery:

● To create your account and verify your identity.

● To display relevant inventory from Vendors in your vicinity.

● To calculate accurate, distance-based delivery fees.

● To process payments and generate invoices using the Fitneter billing software.

● To facilitate the Delivery process by sharing necessary details with the Vendor.

● To facilitate the Self-Pickup process by verifying your identity at the Vendor’s store.

Operational Uses:

● To resolve disputes between you and the Vendor regarding delivery or product quality.

● To help promote safe services and detect fraud (e.g., bypassing the app to pay cash).

● To measure consumer interest in our services and products.

Communication:

● To send you transactional communications (e.g., order confirmation, invoice, delivery status, OTPs).

● To send you marketing communications regarding new sports products or offers (you may opt-out of these).

Improvement:

● To perform data analysis, testing, and research to improve the Platform's stability and user experience.

4. SHARING AND DISCLOSURE OF PERSONAL INFORMATION

We treat your data with the utmost care. We may share or disclose your Personal Information under applicable laws and as per the terms of this Privacy Policy in the following limited circumstances:

Vendors (Crucial for Fulfillment):

● We share your Name, Mobile Number, and Delivery Address with the specific Vendor (Seller) you purchased from.

● Reason: This is mandatory so the Vendor can physically deliver the product to you or verify your identity when you visit the store for pickup.

Payment Gateways:

● We share data with government-authorized payment gateways to process your transactions securely.

Service Providers:

● We may share data with third-party vendors who provide services on our behalf, such as cloud hosting, data analytics, and customer support tools. These entities are bound by contractual obligations to keep personal data confidential.

Legal & Regulatory:

● We may disclose information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal processes.

Business Transfers:

● If Fitneter Technology Private Limited is involved in a merger, acquisition, or sale of assets, your user data may be transferred as part of that business asset. You will be notified via email and/or a prominent notice on our Platform of any change in ownership.

Note on Third-Party Policies:

While your information is shared with third parties (like Vendors or Payment Gateways), the use and processing of your personal information by them are governed by their respective policies. We do not accept any responsibility or liability for the usage of your personal information by these third parties beyond the scope of the Fitneter transaction.

5. STORAGE AND RETENTION OF PERSONAL INFORMATION

● Storage: We store your data on secure cloud servers located in India. By using the Platform, you consent to this transfer.

● Retention: We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy.
